Minnesota's Prediction Market Ban on Hold After Judge's Ruling
A Minnesota judge has issued a temporary injunction against the state's prediction market ban, just days before it was set to take effect. The ruling comes after Kalshi, one of the main prediction market platforms in the jurisdiction, and Polymarket, successfully argued that federal regulation preempts state gaming laws.
US District Judge Katherine Menendez stated that the plaintiffs have shown they are likely to succeed in proving their core argument that federal regulation preempts state gaming laws. However, she also noted that the Minnesota statute may not be preempted in all its applications but found that it is likely preempted in many respects.
Kalshi and Polymarket argued that a ban would disrupt a 'nationally uniform market' and violate First Amendment rights to advertise. The platforms offer sports event and entertainment contracts, with Kalshi accounting for the bulk of the company’s revenue. Minnesota's ban aims to prohibit the operation of prediction market platforms in the state, effectively ousting these companies.

Argus RivenI've spent years at the tables — cash and tournaments — and just as long shaping poker copy behind the scenes: room reviews, bonus fine print, tournament notes. At PokerInsider I write the way I wish more sites would: clear structure, honest trade-offs, no hype. Whether you're new or already grinding, I care about what the offer actually costs you — rake, variance, and the fine print — and I treat responsible play as part of the job, not a footnote.
