Spain to Tax Poker Winnings Based on Net Gains
The Spanish government has announced a significant change in how poker winnings will be taxed. According to a report by El País, confirmed by the Spanish Ministry of Finance, poker players will now be taxed based on their net gains. This means that players can deduct their losses from their winnings before paying taxes.
The new tax rule will be retroactive, effective from January 1, 2012. This change is expected to bring clarity and security to the online poker community, which has been uncertain about the tax implications of their winnings.
The confirmation of this news came after a forero, “suripanto”, reached out to El País for clarification. The newspaper confirmed that the new tax policy will allow players to compensate their gains and losses within the same fiscal period.

Argus RivenI've spent years at the tables — cash and tournaments — and just as long shaping poker copy behind the scenes: room reviews, bonus fine print, tournament notes. At PokerInsider I write the way I wish more sites would: clear structure, honest trade-offs, no hype. Whether you're new or already grinding, I care about what the offer actually costs you — rake, variance, and the fine print — and I treat responsible play as part of the job, not a footnote.
